Scope

This Privacy Notice describes how we collect, use, protect, and process Personal Information we collect from or about you when you visit our website (brinkmannconstructors.com), communicate with us, or otherwise interact with us in your capacity as a customer, contractor, vendor, or supplier. This Privacy Notice does not apply to employees or job applicants of Brinkmann Constructors. Also, this Privacy Notice only applies to construction projects and services offered directly by Brinkmann Constructors and your interactions with Brinkmann Constructors and not any other brands or companies, even if they are owned by the same parent company as us. Throughout this Privacy Notice, we use the term “Services” to describe our construction projects and solutions across the automotive, cold storage, data center, food and beverage, government/institutional, healthcare, hospitality/entertainment, industrial, marketing, multifamily/student housing, office, retail, senior living, and warehouse markets that we have the privilege of serving. 

This Privacy Notice explains how we may use and disclose Personal Information we collect from and about you, as well as your ability to control certain uses of it. By visiting our website, interacting with us, or providing us with your information, you consent to the collection, use, and disclosure of your Personal Information in accordance with the terms of this Privacy Notice. Please review this Privacy Notice carefully to understand these terms and your rights and options with respect to this information. 

If your company or organization has a separate agreement regarding Brinkmann Constructors’ use and processing of Personal Information, to the extent that agreement conflicts with this Privacy Notice, the agreement will control. However, where this Privacy Notice provides additional rights to individuals beyond the rights included in any such agreement, we will also afford individuals with the rights and choices they may have under this Privacy Notice.

Information Collection

The term “Personal Information” in this Privacy Notice means any information which could identify one as an individual, either directly (for example, by name) or indirectly (such as an IP address or other unique identifier), or any information that relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

Brinkmann Constructors collects Personal Information from you directly (such as when you provide it to us or fill out a form or qualification statement on our website), automatically, and from third parties (such as at conferences and trade shows) and other sources (such as industry reports).

Brinkmann Constructors has collected and processed the following categories and types of Personal Information from individuals in the last twelve months:

  • Commercial information, such as construction Services previously purchased or performed or Services or capabilities to be provided by you or us, financial details and references, safety and insurance information, and other information about previous projects and work performed.

  • Geolocation data, such as the physical location of you, your company, or your device that accesses or assists with the provision of our Services and the delivery of our projects to our customers, sometimes as a result of a customer requirement.
  • Sensitive personal information, such as your labor union affiliation, Equal Employment Opportunity Commission (EEOC) demographic data, government issued identification number, and limited claims-related information.
  • Audio, electronic, and visual information, including photographs, videos, drone footage, if you require, access, or assist with the provision of our Services.
  • Inferences we derive from the information we collect to create profiles reflecting the customer’s, contractor’s, vendor’s, or supplier’s preferences, characteristics, capabilities, trends, predispositions, behaviors, attitudes, abilities, and aptitudes.
  • Information categories listed in state statutes, including information listed under California Civil Code Section 1798.80, subdivision (e), such as name and contact information.
  • Social media information, when you share it with us or use it to contact us.
  • Account-related information, such as information related to any account you create or set up with Brinkmann Constructors.
  • Device information and unique device identifiers, such as your IP address, operating system, or the serial number of your device. 
  • Any other Personal Data you choose to provide to us.

We may not collect each of the above categories of Personal Information from every individual who interacts with us, or who uses, accesses, or assists with the provision of our Services.

How We Use Your Personal Information

We process your Personal Information with your consent, to perform our contractual obligations, to provide our customers with the Services they request from us, where it is in our legitimate interest to process such information, or where we have a legal obligation to do so.   • Operate, improve, and enhance our business, construction projects, and Service offerings;
  • Perform our contractual obligations with other entities, organizations, and third parties;
  • Identify trends in the use of our Services;
  • Personalize your experience when you interact with us, including on our website;
  • Understand the effectiveness of our marketing efforts and to tailor our communications to you;
  • Implement our cybersecurity and privacy initiatives;

We may aggregate and de-identify the Personal Information we collect, and create reports based on this aggregated and/or de-identified information that do not personally identify any individuals.

We may also combine Personal Information we receive from or about you from one source with Personal Information we receive from or about you from other sources, or across multiple interactions with you. We may use this information to form a better understanding about you and your preferences, characteristics, capabilities, trends, predispositions, behaviors, attitudes, abilities, and aptitudes, including to be able to tailor our marketing content to you.  

How We Disclose Your Personal Information

Brinkmann Constructors discloses Personal Information we collect for a business purpose to the following categories of third parties and for the following purposes:

  • Service providers, contractors, consultants, suppliers, and vendors, to perform functions on our behalf such as website development and hosting, marketing automation, analytics, site optimization, payment processing, and other construction services that we contract for;
  • Corporate affiliates and parent companies, to provide and maintain our Services, to benchmark our projects and Services against our corporate goals, and for financial and administrative purposes;
  • Successor entities. If we sell all or part of our business, make a sale or transfer of assets, or are otherwise involved in a merger, restructuring, or business transfer, including as part of the due diligence and transaction process;
  • Court orders, law enforcement requests, and legal process. Under applicable law, including laws outside your jurisdiction, to comply with subpoenas and other legal processes;

Sales and Sharing of Personal Information, and Use of Personal Information for Targeted Advertising

Brinkmann Constructors does not “sell” Personal Information in the traditional sense of the word, but in the last twelve months, we have shared Personal Information, including identifiers, commercial information, internet or similar network activity, inferences, social media information, and geolocation data with providers of analytics services. This sharing and disclosure is considered a “sale” or “sharing” of Personal Information under some state laws. Brinkmann Constructors does not engage in cross-context behavioral advertising, also known as targeted advertising.

If you are a resident of certain jurisdictions, including California, Colorado, and Virginia, you may have the right to opt-out of the sale of your Personal Information to third parties, and/or to limit our use and disclosure of your information for targeted advertising. Opt-Out of Correspondence

Right to Deletion or Right to Erasure

Depending on the jurisdiction in which you reside, you may have the right to request that we delete any of the Personal Information that we collect or retain about you, subject to certain exceptions. After we receive and verify your request, we will delete (and direct any third parties that hold your Personal Information on our behalf to delete) your Personal Information from our records, unless an exception applies. We may deny your deletion request if retaining your Personal Information is necessary for us, as permitted by law.

Right to Opt-Out of the Sale or Sharing of Personal Information, or the Use of Personal Information for Targeted Advertising

As indicated above in the section titled “Sales and Sharing of Personal Information, and Use of Personal information for Targeted Advertising,” in the last twelve months, we have not “sold” or “shared” Personal Information. If you still wish to express your preferences to us to not sell or share your Personal Information, you may exercise your right to opt-out by following the instructions set forth in the section of this Privacy Notice titled “Exercising Your Rights.”

Depending on the jurisdiction in which you reside, you may have the right to limit our use and disclosure of your “Sensitive Personal Information,” as that term is defined in applicable statutes, where we have collected it to use as necessary to perform the Services or provide construction projects or solutions reasonably expected by you, and as otherwise authorized by applicable statute and regulations. Other than union membership affiliation, EEOC demographic data, government issued identification numbers, and limited claims-related information, we do not knowingly collect Sensitive Personal Information from our customers, contractors, vendors, and suppliers. If this changes, we will only use your Sensitive Personal Information in ways that you would reasonably expect are necessary to perform the Services or to provide construction projects or solutions our customers request.

Right to Correct Personal Information if the Information is Inaccurate

If you believe or discover that Personal Information we have collected about you is inaccurate, you may contact us to request that we correct and update the information so that it is accurate.

Right to Restrict or Object to Processing

Depending on the jurisdiction in which you reside, you may have the right to restrict certain processing of your Personal Information, or to object to certain processing of your Personal Information, including where our legal basis for the processing is your consent, where the processing involves Sensitive Personal Information, or where the processing involves automated decision-making technologies. This right is subject to certain restrictions.

Right to Appeal

If you are a resident of certain jurisdictions, you may have the right to file an appeal with us if we deny your request to exercise your rights. Requests to appeal can be communicated through the same means by which your request was submitted. If we deny your appeal, you may have the right to appeal to a regulator in your jurisdiction. We will provide you the information of the applicable regulator if we deny your appeal.

Only you, or someone legally authorized to act on your behalf, may make a verifiable request related to your Personal Information.

You may only make a verifiable request for access or data portability twice within a twelve-month period. The verifiable request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will take steps to verify your request, including that you are the person making the request, or you have authority to make the request on behalf of the individual the request relates to. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable request does not require you to create an account with us. We will only use Personal Information provided in a verifiable request to verify the requestor’s identity or authority to make the request.

Response Timing and Format: We will endeavor to respond to requests within forty-five days of receipt. If we require more time (up to ninety days), we will inform you of the reason and extension period in writing. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve-month period preceding the verifiable request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Children’s Privacy

Our website is provided for and targeted to adults and is not intended to be used by children under eighteen years of age. We do not knowingly collect Personal Information from children and individuals under the age of eighteen through our website. If you believe we have been provided Personal Information from or about a child under eighteen, please contact us at the email below. If we have stored any such Personal Information in our database, we will delete it as soon as reasonably practicable after receiving notice from you.
